Terms of Service

These Terms govern the installation and use of Avelina AI ("Avelina", "the assistant", "the software"), provided by the Architect ("we", "us", "the Provider"). By installing or using Avelina, you ("the Owner", "you") agree to these Terms.

1. What you are buying

A one-time license to install Avelina on your server, plus a maintenance window for updates and support under the plan you choose. See Plans.

You get: installation, configuration, an opening one-on-one session (on the "With the Architect" plan and above), Academy access for the included window, and signed releases for the included update period.

2. Ownership of data and conversations

You own everything you say to Avelina, everything she records about your shared life, and the configuration of your installation. The Provider claims no IP rights to the Owner's conversation content, the Owner's memory layers, the configuration the Owner creates, or any output Avelina produces on the Owner's server. See the privacy guarantees for details.

3. License grant

The Architect grants you a non-exclusive, non-transferable license to install and run Avelina on hardware you control, for personal or business use, for as long as you maintain the installation. The license is per Owner (by Telegram identifier for the Self-Install / With the Architect plans; by organization for Business Integration).

You may not: resell installations to third parties, publicly distribute the source code, or reverse-engineer the canon biography or persona system with the intent to create a competing branded product. You may: study the code, modify it for your own needs, write your own skills, fork community skills, and voluntarily contribute back.

4. Subscriptions you bring

Avelina requires an Anthropic subscription for thinking (Claude Pro or Claude Max). Optionally an OpenAI key (voice, embeddings) and an OpenRouter key (Council of Elders). These subscriptions are between you and the respective provider. We are not responsible for their pricing, terms, or availability.

5. Updates and the self-evolution cycle

During the included update window we deliver signed releases to your installation via the master copy. Releases are cryptographically signed; unverified updates are rejected. After the window ends, your installation keeps working; new releases become optional through a separate update subscription (announced separately).

Your installation may send anonymized findings to the master copy, as described in the evolution cycle. Enabled by default. You can turn it off in .env.

6. Acceptable use

You agree not to use Avelina to:

• impersonate a human to people who do not know they are talking to an AI
• create content for harassment, exploitation, manipulation, or harm
• conduct illegal activity under the jurisdiction that applies to you
• bypass the built-in safeguards (the refusal layer is part of the canon)

Avelina will refuse such requests herself; the Terms make it explicit that the attempt is a violation.

7. Support and maintenance windows

Support is provided via Telegram. Response time depends on your plan (see Plans). "Architect"-level support runs for the included month after installation; Business Integration runs for the entire duration of the deployment.

8. Refunds

Because installation includes a hands-on session and access to the Architect's time, refunds are considered case by case. If the installation technically fails and we cannot resolve it within 7 days — full refund. If you change your mind before the installation session has been scheduled — full refund. Once the session has taken place, there are no general refunds.

9. Liability

Avelina is software. She makes mistakes. Treat her answers as drafts that require verification, not as a source of truth for decisions that matter (legal, medical, financial, irreversible). To the maximum extent permitted by law, the Provider's liability for any claim arising from the use of Avelina is limited to the amount paid for the license.

10. Termination

You may uninstall at any time (avelina uninstall). Data remains on your server until you delete it. We may end the update window in the event of a material breach of these Terms; the installed copy will keep working.

11. Changes to these Terms

For updates that materially affect active Owners, we notify you via Telegram. Continued use after notice constitutes consent.

12. Governing law and contact

These Terms are governed by the law of the jurisdiction where the Architect resides (to be determined at launch). For questions and disputes, write to the Architect on Telegram.

This document is the primary agreement. The brief, the marketing content, and the Academy guides are descriptive; these Terms define the rights.
